The American Civil War was no different, and it has gone down as a moral war that pitted brother against brother, spilt the blood of hundreds of thousands Americans, and showed the world that all men truly were created equal. This war showed the world that America was willing to do whatever it took to be one nation, indivisible with liberty, and justice for all. The Confederates did not share this same worldview. For the South, there was nothing Civil about this war. This was a revolution. Misguided or not, the Southern States saw the Union as a tyrannical oppressor, and they wanted their freedom. They wanted to become a sovereign nation. They wanted to become the Confederate States of America. This was easier said than done. To the United States of America, the Confederacy was an insurrection that needed to be extinguished. The longer the war waged, the better suited the Union was to win the war . If the Confederate States were to survive, they needed international help. Badly. The primary reason for the Confederate States of America’s fervent attempts at diplomacy was to be recognized by European powers as a sovereign state. Picking Up Trash Can Result In Future Ambitions free essay sample

It’s 4:04 in the afternoon at Angels Care Center in Cannon Falls. After greeting wrinkled, half-asleep faces down the hallway, I make it to my final destination of the night: the 300 wing. As soon as I press a tiny black button and enter the locked memory care unit, G a toothless, enthusiastic woman comes rifling down the narrow hallway. Head down in her hot wheels, she races towards me gripping a curious transparent bag. It doesn’t take long for me to realize it is a garbage bag on account of the trail of wet paper towels and half empty yogurt containers G has left me. I take a deep breath and greet her beaming grin with a forgiving smile. Innocent mischief is unavoidable in the three hundred wing and, strangely, I’ve learned a tremendous amount from these seemingly insignificant instances. As G accompanies me on my scavenger hunt down the hall, clapping like she is cheering me on, I reminisce. We will write a custom essay sample on Picking Up Trash Can Result In Future Ambitions or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page On our way to select a fashionable pair of gloves for me to wear, we pass R’s former room on the left, and I recall when he still resided in the unit. I was nervous meeting the tiny Latino man because I had heard stories he was uncontrollable and fierce. But to my surprise, when I did meet him, he was just sitting at the table playing a game of Dominoes in the most relaxed manner. One game of Mexican Dominoes with him, and I had discovered that this man was anything but menacing. If the accusations about R were proven false, then how could I believe any others that I heard? Later, perhaps that week, I was sitting in class when a girl in yoga pants that have never been to yoga was attempting to â€Å"keep me up with the gossip.† She didn’t catch on to my disinterest and asked what I thought about it all. I told her the only way to know the truth about all the people she evaluated was to go ask them. I guess G lost interest in my sterilization of the hallway and wandered into M’s room. While having a tug of war to remove G, I gazed over at M sleeping soundly in her bed. M has a daughter who frequently reminds me of every single thing she hates about Angels Care Center. So, I listen to her critical views and try to figure out where she is coming from so I can attempt to assist. That skill was extremely useful when my mom was struggling with her body image and I persuaded her to purchase a gym membership. She jumped right into a healthier lifestyle with me, which strengthened our relationship and revived her happiness. It’s 4:16 and the hallway looks as fresh as the fully stocked linen closet. G has found her way into S’s room, forgetting that her presence is frowned upon by the short-tempered man. I snatch her out of there before the soft-toned yelling could erupt, and look into her faded blue eyes full of life. She laughs either with or at me it’s hard to tell and I realize that I want to live like G: spirited and adventurous. Everyone has their own idea of success, but mine consists of having a career I’m passionate about, traveling frequently and maintaining relationships with my family while forming new friendships. I want to use the skills I’ve obtained from working at Angels Care Center to reach my goals and impact the lives of other people.

Privity of Contract free essay sample

The basic answer to this question is NO, as the following literature supports and explains this fact effectively. A contract is an agreement between two or more parties that creates an obligation to do or not to do something. The parties to the contract are under an obligation to perform the terms and conditions as laid down in the contract. Thus a contract can confer rights or impose obligations arising under the contract on the parties to the contract. Third parties cannot be under such an obligation to perform or demand erformance under a contract. This is referred to as Privity of contract. The Doctrine of Privity of Contract under English Law The doctrine of Privity of Contract which means that a contract is a contract between the parties only and no stranger to the contract can sue even if the contract is avowedly made for his benefit. Thus a stranger to the consideration cannot sustain the action on the promise made between two persons unless he has in some way intervened in the agreement. We will write a custom essay sample on Privity of Contract or any similar topic specifically for you Do Not WasteYour Time HIRE WRITER Only 13.90 / page As the plaintiff was to be married to the daughter of G and in consideration of this ntended marriage G and the plaintiffs father entered into a written agreement by which it was agreed that each would pay the plaintiff a sum of the money. G failed to do so and the plaintiff sued his executors. Thus, although the sole object of the contract was to secure a benefit to the plaintiff, he was not allowed to sue as the contract was made with his father and not with him The two basic principles under the English Law as can be ascertained from the above cases are that firstly consideration should move from the promisee only and secondly hat a contract cannot be enforced by a person who is not a party to the contract even if it is made for his benefit. The Doctrine in India There has been a divergence of opinion in India as to whether the Doctrine of Privity of Contract, which prevails in the English Courts, is applicable to the Indian Courts. The Indian Contract Act, 1872 (here in after referred to as the Act) codifies the methods of entering into a contract, executing a contract; rules to implement provisions of a contract and effects of breach of a contract. The provisions of the Act revail over any usage or custom or trade however the same will be valid as long as it is not inconsistent with provisions of the Act. ny other person has done or abstained from doing, or does or abstains from doing, or promises to do or to abstain from doing, something , such act or abstinence or promise is called a consideration for the promise It is clear from this section that the consideration for a contract can proceed from any person and not necessarily the parties to the contract. A promise is enforceable if there is some consideration for it and it is quite immaterial whether it moves from he promisee or any other person. However there is no specific provision in the Act which either for or against the Doctrine of Privity of Contact. It is through a series of case laws that the Doctrine has evolved. There are two aspects of this doctrine. Firstly, no one but the parties to the contract are entitled under it. Rights or benefits may be conferred upon a third party but such a third party can neither sue under the contract nor rely on defenses based on the contract. The second aspect is that the parties to a contract cannot impose liabilities on a third party. Conclusion The Act does not specifically provide for the doctrine of Privity of Contract, however through a series of case laws the doctrine is now applicable in India along with various exceptions. With reference to consideration of a contract the position in India and England are however different. Under the English law only a party to the contract can pay the consideration. If he doesnt pay the consideration he becomes a stranger to the contract. Under the Indian Law, it is not necessary that consideration should be paid by the promisee. Though there are no express provisions as to assignment of rights and obligations nder a contract in the Act, the Principle of assignment has been recognized and developed by the courts through its various decisions. A person may not give any consideration, but is a party to the contract may enforce the contract A stranger to a contract cannot sue : Suppose A and B enter into a contract for the benefit of C. The agreement between and A and B cannot be enforced by C. e. g. Two father entered into an agreement to pay a new couple money on their marriage. The couple cannot sue for enforcement of the contract between the fathers.

One Fell Swoop

One Fell Swoop One Fell Swoop One Fell Swoop By Simon Kewin Its quite common for people to use the phrase one fowl swoop (or even one foul swoop) when they want to convey the idea of an event taking place all at once and very suddenly. But why do we say this? Is the phrase something to do with birds swooping to the ground in a great rush? In fact the phrase does have some connection to birds but both one fowl swoop and one foul swoop are incorrect. The original phrase is actually one fell swoop. The phrase is an old one. It may have been coined by Shakespeare in 1605, or he may merely have popularised it. In any case, the following lines can be found in Macbeth (Act 4, scene 3). Macduff has just heard that his family have been killed: All my pretty ones? Did you say all?- O hell-kite!- All? What, all my pretty chickens, and their dam, At one fell swoop? So Shakespeare does employ the image of a bird of prey, a hell-kite, swooping to the ground to kill all his pretty chickens. But the word he uses is fell. This, of course, is still a common word, but Shakespeare is using a rather obscure sense of that word, meaning of terrible evil or ferocity. Its source is the same as felon, a wicked person. So, â€Å"one fell swoop† originally meant a sudden, ferocious attack, although the sense of savagery in the phrase has been lost over the years and people now use it to mean, simply, all at once. Footnote : the dive of a bird of prey is more accurately referred to as a stoop rather than a swoop as in, for example, â€Å"the peregrine falcon can reach speeds of over 200 mph in a stoop†.
